Sa pagdinig ng Senate Impeachment Court, inimbitahan ang mga retiradong mahistrado ng Korte Suprema upang magbigay ng kanilang legal na kaalaman at karanasan hinggil sa interpretasyon ng probisyon ng 1987 Constitution na nangangailangan ng two-thirds vote of all the members of the Senate para sa conviction.
Iginiit ni retired Supreme Court Chief Justice Hilario Davide Jr. na ang batayan sa pagkukuwenta ng two-thirds vote sa impeachment trial ay dapat ang bilang ng mga senador na kwalipikadong bumoto, at hindi awtomatikong ang 24 na miyembro ng Senado.
Hindi personal na dumalo si Davide sa Senate Impeachment Court. Sa halip, nagsumite nalamang ng kanyang kanyang written legal memorandum.
“The basis of computing the two-thirds must be the number of Senators who are qualified to vote, Not the 24 in the present Senate. All those disqualified by reason of causes should not be included.” saad ni Davide
Para naman kay i retired Supreme Court Chief Justice Artemio Panganiban ang kanyang pananaw sa posibilidad na bumoto ang mga senador na hindi nakadalo sa mga pagdinig ng impeachment trial.
“Is it truthful and fair to allow senators to cast their votes despites being absent in hiding, abroad, legally detained, sick, hospitalized or otherwise absent, and have not been able to access and examine the documents have not heard the testimonies and have not observed the demeanor of the witness.” saad ni Panganiban
Sinabi ni dating Supreme Court Associate Justice Adolfo Azcuna na maaari pa ring bumoto ang isang senator-judge kahit hindi ito nakadalo sa mga pagdinig ng impeachment trial.
Ayon kay Azcuna, kung naniniwala ang isang senador na kaya niyang magbigay ng patas at tapat na hatol batay sa buong rekord ng kaso at alinsunod sa Konstitusyon at batas, maaari umano itong bumoto sa impeachment proceedings.
“If he or she feels that he or she can render impartial judgment honestly, according to the Constitution and the laws, that even if he missed one or two, or maybe even substantially most of the hearings, but still, based on the record, he or she feels that he can honestly judge the respondent, I would allow. But that’s me.” saad ni Azcuna
Para naman kay retired Supreme Court Associate Justice Reynato Puno na ang bilang ng boto para sa impeachment conviction ay nakabatay sa “two-thirds of all the Members of the Senate.”
Ayon sa kanya, dahil fraction ang ginamit sa Konstitusyon, maaaring magbago ang kinakailangang bilang ng boto depende sa kabuuang bilang ng mga miyembro ng Senado.
“If that is the intent, Article 11, Section 3(6) should have simply stated that the number of votes to convict is 16, period. But Article 11, Section 3(6) did not say so. Instead, the language used a fraction.” saad ni Puno.
